I have a question. Our files are stuck in the Chicago local office (after our interview last year) and the only thing pending is the Namecheck, which has been pending for more than 180 days. Our PD is current. Is anyone in the same position?
It is frustrating because you do not get any LUDs when your files are in the local office and I have no indication whether the Chicago officeis processing cases with NC pending > 180 days. Anyone knows?

Hi gurus,
I have been working with employer A since last 3 years. My I-140 (EB3)has been filed on April 1, 2008 and my priority date is January 9, 2008. I am planning on changing jobs within the same company but in a different state / city.
1)Would this affect my I-140 processing
2) Would this create any issues in the future stages of the green card process
3)Will I still be able to keep the same priority date for the I-485 (God knows when I'll get to that stage...)

I think you should be fine. Apart from this scenario on the other extreme you could start working for the new company with just the receipt number as well. You dont need to wait for the approval to start working for the new company.

few days ago, I tried to extend H4 visa for my spouse but I heard through one of the lawyer in the firm that once H4 visa holder used EAD, H4 becames invalid unless you enter again in POE using H4, we cant apply for H4 extension as the current status is AOS. But we are still exploring it.
I checked in H4 extension form I-539, they ask:
1. current immigration status?
2. whether you want to extend current status or change of status?
But my spouse is working so if we say change status to H4 from AOS then not sure whether she can use immediately EAD to work? I opened a thread regarding this.
Anybody experienced the same issue as above? Thanks.

It has limited relevance, the issue is the integrity of the Senator, he has admitted to the issue at hand but he went on the Senate floor as an elected public official to make declaratory and restrictionist anti-immigration statements, attacked immigrants, proposed and supported anti-immigrant ammendments and all this with the foundation of his positive public image, integrity and moral uprightness. We are thus not discussing the list he is on, but are simply taking note of the Senator's credibility on an issue that affects us. Anything beyond that would be inappropriate and not relevant to our issues.

Hi,
I have a question regarding Priority Date Re-capture. When a new I-140 is filed requesting priority date re-capture from the old I-140, what happens to the old I-140. I hope the old I-140 is not cancelled. The reason I ask is, if the new I-140 runs into any issues, I don't want to lose the old I-140 as well. Thanks.

There was a report on Mathew Oh's site that
some people travelled in 2008 got a messed up I-94
forms( printing bug). So whoever travelled in 2008
may want to have a very good look at their I-94 and
correct it if needed.

Correct and valid I-94 should have 11 digits of I-94 numbers. If your I-94 shows only 9 didits or 10 digits or less than 11 digits, your I-94 card is one of these million's defective cards. The agency is recalling such defective I-94 cards for replacement I-94. Reportedly these defective I-94 cards were issued at the Calgary Airport in Canada and potentially other airports as well. Those who have such defective I-94 should contact Deferred Inspection posts or any Port of Entry for issuance of replacement I-94. Defective I-94 can create a number of problems down the road unless they obtain replacement I-94.

The Majority consisting of conservative justices---- Alito, Roberts, Scalia, Thomas, and Kennedy based their decision on the history of the second Amendment, where militias were given the right to protect their farmlands. At that time we had no organized police force, we had no justice system in place.
Who are the militias of today? The KKK-- the uneducated people, who generally do not work, collect welfare checks, and blame all their owes on the colored people and now the "illegal immigrants."
If the Supreme Court grants the right to local levels to enact gun controls, one can only speculate for instance what kind of gun control laws Maricopa COunty in Arizona will enact.

Although the justices said that the Second Amendment allows for a reasonable restriction of guns, their rationale based on history of the second Amendment gives the militias a carte blanche right to bear arms. This can indeed set a dangerous precedence.

The President has started revealing his plans on immigration for the next year. It sounds like he's planning on trying a do-over with Congress and attempting again to get a comprehensive immigration bill passed. He'll make the case for this in his State of the Union Address. I'm happy the President is still interested in working for change, I sincerely hope he is not making passing a reform bill his SOLE strategy. I'm reminded of Presidents in the past who regularly spoke in favor of something, but you just knew they didn't really care and were just trying to appease...

I suspect, if the camera has a chargable clock battery, it's NOT a "user-servicable" part. The idea is that they don't break.
That's just a guess - I don't have a D70, so I don't know for sure.
I did a few entries in Google, with the result that I'm fairly sure the clock-battery is an internal non-user-changable battery [particularly a reference to the same technology being used on a Nikon D1].
I expect that aside from the inconvenience and shipping cost, the service is fairly reasonable in cost... But that's just a guess...

A brief background: I have approved labor (PD Jun04/EB3), I-140 rejected & pending I-140 (MTR filled in Jan'07) with attorney A. Meanwhile got PERM LC approved & filled I-140 & I-485concurrently in Aug.07 thru Attorney B (recipt recived).(FYI....the same company did Old & New PERM Labor)
Now the question is, If my old I-140 gets approved, than do I have any benefit/advantage using that Old approved I-140 PD of Jun04 when my new I-140 gets approved? In short, can I still use my OLD priority date? (Jun04).(even though I have already concurrently filled New I-140 & I-485 in aug.07).
Any thoughts/suggestions/advice/ideas are appreciated. thanks.

what makes you think that i am an anti-immigrant, and do you think that i am giving publicity. this is from an ad that i came across that says that 1.5 million immigrants are being brought into the country to work annually. i wanted to bring this to the attention of the forum so that we can do something to stop this false information propagation. otherwise, think about the hatred the american public will have when the time comes for CIR to be implemented. for every call we make, there will be 10 calls to oppose. unless we stand up and fight the misinformation, we are not going to see any progress. and maybe it is easy for you to label anyone as an anti-immigrant being an EB2. I lost out on my 2001 PD due to the mistake of my lawyer and am now saddled with a 2004 PD. Easy for you to talk, when you dont know the issues that those of us who are languishing for more than 10 years here are going through.

Mine rejected case has status "OTHER REASONS" and receipt number is voidand it starts with "MSC". I did not receive package back yet.

the only difeerence is in the ease with which you shift employers.
when it was not called transfer you had to wait for approval of new H1 but now you can start working for new employer upon getting the receipt.

I just joined a new company and would like to use AC21 as I will be working on EAD. 140 is approved and 485 is pending for more than 180 days. New job is same or similar as per ONET job code.
My question is,
Is it necessary to involve your attorney or you can simply go ahead and file AC21 yourself?
I would like to what others have done? What kind of extra fees your attorney has charged for AC21?

There is nothing called AC21 filing ie AC21 does not have a form that you fill out etc.... generally Attorneys attach the docs with a covering letter citing the AC21 clause and from what I understand, these docs may/may not get into your file.
The advantage of using an Attorney is,
(1) G28 filing - Attorney will get communication and be in position to respond or guide appropriately
(2) NOID, RFE and denials might happen and MTR may have to be filed.
Most times, issues arise when old employer withdraws the 140 petition.
USCIS needs to have a better way of handling this and avoid unnecessary tensions and errors

Is this for H4 renewal or first time H4. If its for renewal she can go to any US consulate in India. However, if it is first time she has to go the consulate that falls in her zone i.e her place of residence. Confirm it with VFS.

I am wondering if I can sent both my and mywifes EAD applications in one envelope to USCIS or do I have to send them separately. I am not asking to save money on postal costs , as everyone knows we all spent 1000's of dollars in this GC process. I am only asking so that our(my and mywife) applications are processed together?
