Yes, unfortunately that is true. You can not use the experience that you gained with the current sponsoring emplloyer for your permanent residency application.

I'm having a little trouble with counting the years of experience for my EB2 petition. My attorney said I can only count the number of years I worked before joining the current sponsoring company!! The situation is, I jointed this company in Jan 2004. But my petition (Labor) appliction only started at the end of 2006. My attorney says that the three years of working experience (04, 05 & 06) can not be counted!
Is he correct on this?

I got my Finger Printing notice today and I was comparing it with the 485 receipt. The 485 receipt had A# as A9xxxxxxx ( A with 8 digits) as the receipt number while the FP notice had A09xxxxxxx as the number.
The FP notice has a "0" after the "A" and the 485 notice does not have that 0. All the digits are the same but for the 0. Any one has it similar. do i need to worry abt it? any suggestions? You think i need to get it corrected?

I heard from some source that non citizens cannot donate blood... if this is not true then count me in ....
Citizenship is a non-issue. If I correctly, the only bar on blood donations arise from recent overseas travel (2 years or 4 years?) to one of the 'high-risk' malaria areas in the world.

Hi,
I am on H1, Applied EAD and Travelling on AP.
Is there a problem if I don't have approved EAD while I come back?
Please note EAD has nothing to do with travel.
EAD is authorization to work while adjusting your status.
AP is advance paroled document which you require when AOS is pending, you will be admitted in as parolee.

I recently came back from India, and got a new I-94 at port of entry, but later I noticed that CBP officer added 10 more days to my I-94 expiry(it may be a mistake by the officer)
Do I need to worry about this? any advice/suggetion?

My father (over 60 years) is coming to the States in June 15, and his B1 visa expires on June 24. However, my father is planning to stay until August 20.
My question is:
Will he be able to stay after his visa expiration date?
In other words, when will his I-94 expire?

Once your father enters the US, the expiry of the visa does not matter. Your father will be able to stay in the US till the expiry of the I-94.
The expiry of the I-94 will be determined by the officer at the port of entry. Usually, for parents, it is granted for 6 months, but there is no hard and fast rule and it totally depends on the officer who is stamping the I-94. However, I think for B-1, the max. duration is usually six months (again - not 100% sure about this - it could be longer too).

I think you should apply for H1 extensions about 6 months in advance even if u have applied for AOS. Your driver license might also expire with your H1-b and to renew your license you will need approved H1-Extension. Also just in case something goes wrong with your AOS application and it gets denied, you might be out of status.
I would strongly suggest that you apply for H1-Extension well in advance just to be on safe side.

I-140 is only for the beneficiary, i believe in the form you need to mention your spouse and children names but the reciept notice or approval notice only contains beneficiary name.
