There is a 245(K) provision that will save your wife - research that and ask your attorney to file 485 for her with that.

Hi,
I came in US on 5-Jun-2006 on L2 visa & then changed status to H4 after 6 months & then applied for H1 & started working & now I'm on H1 & now I want to go back to H4. I never left the US during these change of status from L2 --> H4 --> H1
The Part 3 of form I-539 is asking below questions:
1. I/We request that my/our current or requested status be extended until***** (mm/dd/yyyy): __________
Here, actually, I'm applying for change of status & not extension. Should I write N/A or the I-94 expiry date of my spouse's H1 petition?
2. Is this application based on an extension or change of status already granted to your spouse, child, or parent?
Here, should I say Yes or No??
3. Is this application based on a separate petition or application to give your spouse,*child, or parent an extension or change of status?
Here, should I say Yes or No?
I would really appreciate if you can help me, Ginnu!!!

I am from Ireland and its for a Multi national manager or executive. My attorney told me that form her experience it takes 4-6 weeks after approval of the I-140 as the visa numbers are current. Bit apprehensive to give the company as I dont see a need for anyone to know this info???

Could you please let me know if I can buy the health insurance only for her? Is there some law which states H1B visa holder also needs to buy the health insurance along with the spouse?

My wife had concived for 3 days in June. During immigration medical exams Doctor gave her MMR shots and stated don't get pregnant for another 3 months.
After 15 days, We came to know that she is pregnant.
last week my wife had miscarriage after 18 weeks of pregnancy. Not sure it's because of MMR or something else.

If you have filed G28, your attorney on record will get the approval notice (3 hard copies).
On USCIS website, my I131 messages says as Document approved and..so on on Nov 1. Till date I haven'yt recd. any copies yet. Will it come to me or Lawyers?

You can file H1-B extension based on your approved i-140 you should receive another 3 yrs extension i did the same.

c)September 2008 I have Joined employer �B� by transferring H1B (Valid until Aug 2010).
d) Employer A revoked 140 which triggered 485 denial in October 2008.
e)Applied MTR and it was approved in NOVEMBER 2008 and 485 reopened.
f)Applied AP & EAD renewal ,got a EAD card September 2010
g) Since EAD extension got delayed I have applied H1-B Renewal August 1st week of 2010 and got a RFE now asking for proof how beneficiary qualify to extend beyond six years?

1)I have EAD approved and it�s valid until 2012 September .Is it possible can we withdraw HI-B Petition application when they request RFE?
2)Can I have any chance of explain USCIS, by this rule below?
��USCIS has also specifically stated that if an approved I-140 is withdrawn after an I-485 has been pending for more than 180 days, the I-140 remains valid for purposes of AC21 � 106(c) portabilty:
"If the Form I-140 has been approved and the Form I-485 has been filed and remained unadjudicated for 180 days or more (as measured from the form I-485 receipt date), the approved Form I-140 will remain valid even if the alien changes jobs or employers as long as the new offer of employment is in the same or similar occupation." AFM Sec. 20.2(c) ��

I have just gone thru March recording of IV lawyer call and the below caught my attention. Ms Susan mentioned that any company name change after I140 approval has to refile I 140. I am utterly confused as that particular scenario affect me and i would like to know what best course of action i can take at this point.
I filed LC and I 140 with company A
My I 140 got approved
Before i filed my I 485 my company changed its name
I asked my attorney at that time if we need to take any special action
Attorney said they can just add an amendment while applying for I 485 about name change and apply with approved I 140, which is with old company name.
I and my wife work on EAD for past 3 years and i am still employed with same company. I wonder which one of above attorney is correct and what i should do.
Does the fact that my I485 is pending for more than 180 days after approval of my I 140 will come to rescue in case of question about company name change (AC21)

We have done FP thrice and they took finger prints of tips (the top 1/3 ) of th fingers. They did not took finger prints of whole hand. But for us they took finger prints of both left and right hand fingers.

i feel down recently and i scraped my hand on the concrete, and i am worried about finger printing which i have soon. My palm is scratched mostly and smy fingers on my left hand are also scratched, most of my right hand is okay but there are some scratches too.
Do they take prints of the whole hand or just the index finger?
